Dreamee Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing or using the Dreamee mobile application (« the Application », « the Service »), you agree to be bound by these Terms of Service (« ToS », « Terms »).

If you do not accept these Terms, please do not use the Application.

These Terms constitute a legal agreement between you (« User », « you », « your ») and Dimosapps (« we », « our », « us »).

2. Description of Service

Dreamee is a mobile application designed to support you in learning lucid dreaming and keeping a dream journal. The Application notably offers:

• Dream journal: Recording and organising your dreams
• Calendar: Viewing your dreams on a calendar
• Statistics: Analysis of your dreaming habits and progress
• Automatic analyses: AI-generated analyses of your dreams (Pro feature)
• Guides and courses: Educational content on lucid dreaming
• Reality checks: Custom reminders to practice reality checks
• Cloud sync: Backing up and syncing your data across devices

3. Eligibility and User Account

3.1. Eligibility

To use Dreamee, you must:

• Be at least 13 years old (or 16 in some European Union countries)
• Have the legal capacity to enter into a contract
• Not be prohibited from using the Application under applicable laws

If you are under 18, you declare that you have obtained the consent of your parent or legal guardian to use the Application.

3.2. Account Creation

To use certain features of the Application, you must create an account by providing:

• A valid email address
• A secure password
• Or by using Google or Apple Sign In authentication

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised use of your account

3.3. Accuracy of Information

You agree to provide accurate, complete and up-to-date information when creating your account and when updating your information.

4. Use of the Application

4.1. Authorised Use

You are authorised to use the Application only for personal, non-commercial purposes, in accordance with these Terms and all applicable laws and regulations.

4.2. Prohibited Uses

It is strictly prohibited to:

• Use the Application for illegal or unauthorised purposes
• Attempt to gain unauthorised access to the Application, servers or related systems
• Use robots, automated scripts or other means to access the Application
• Copy, modify, distribute, sell or rent any part of the Application
• Reverse engineer, decompile or disassemble the Application
• Remove or alter any copyright, trademark or other proprietary notice
• Transmit viruses, malicious code or any other harmful element
• Use the Application in a way that violates others' intellectual property rights
• Collect or store personal data about other users without their consent
• Use the Application to harass, threaten, intimidate or harm others
• Post offensive, defamatory, obscene, illegal or otherwise inappropriate content

4.3. User Content

You retain all ownership rights to the content you create, save or publish via the Application (your dreams, notes, etc.).

By using the Application, you grant Dimosapps a non-exclusive, worldwide, royalty-free, transferable licence to use, store, process and display your content solely for the purpose of providing and improving the Service.

You warrant that you have all rights necessary to grant this licence and that your content does not infringe any third-party rights.

5. Subscriptions and Payments

5.1. Free and Premium Features

Dreamee offers two access levels:

Free Version:

• Unlimited dream journal
• Calendar
• Basic statistics
• 2 guides
• 2 reality checks

Pro Version (paid subscription):

• All free version features
• AI-powered automatic analyses
• Advanced statistics
• Custom reality checks
• Full access to all guides and courses
• Cloud sync

5.2. Pricing

Pro subscriptions are available at the following rates:

• Monthly subscription: €4.99 per month
• Annual subscription: €39.99 per year

Prices may vary by location and are shown in the Application at the time of purchase.

5.3. Trial Period

A 7-day free trial may be offered for the Pro subscription. At the end of the trial, your subscription will automatically renew at the applicable rate unless you cancel before the end of the trial.

5.4. Billing and Renewal

• Subscriptions are billed through your Apple (App Store) or Google (Play Store) account
• Subscriptions automatically renew at the end of each period unless cancelled
• The amount will be charged to your account 24 hours before the end of the current period
• You can manage and cancel your subscriptions in your App Store or Play Store account settings

5.5. Cancellation and Refunds

• You may cancel your subscription at any time in your App Store or Play Store account settings
• Cancellation takes effect at the end of the current billing period
• Refunds are subject to Apple and Google policies
• Generally, refunds are not available for partially used periods unless required by law

5.6. Price Changes

We reserve the right to change our subscription prices at any time. Any price change will be communicated in advance and will apply to subsequent renewals.

6. Intellectual Property

6.1. Rights in the Application

The Application, including but not limited to its source code, design, graphics, logos, text, features and content, is the exclusive property of Dimosapps and is protected by copyright, trademark and other intellectual property laws.

6.2. Trademarks

« Dreamee » and associated logos are trademarks of Dimosapps. You may not use these marks without our prior written permission.

6.3. Third-Party Content

The Application may contain content provided by third parties or links to third-party websites. We are not responsible for the content or practices of such third parties.

7. Service Availability and Modifications

7.1. Availability

We strive to keep the Application available 24/7 but do not guarantee uninterrupted availability. The Application may be temporarily unavailable for maintenance, updates or other reasons.

7.2. Modifications and Interruptions

We reserve the right to:

• Modify, suspend or discontinue any or all of the Application at any time
• Add or remove features
• Modify the Terms at any time (see section 13)

We shall not be liable to you or any third party for any modification, suspension or discontinuation of the Application.

8. Limitation of Liability

8.1. No Warranty

THE APPLICATION IS PROVIDED « AS IS » AND « AS AVAILABLE », WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

We do not warrant that:

• The Application will meet your requirements
• The Application will be uninterrupted, timely, secure or error-free
• Results obtained from the use of the Application will be accurate or reliable
• Defects in the Application will be corrected

8.2. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Dimosapps SHALL NOT BE LIABLE FOR:

• Any direct, indirect, incidental, special, consequential or punitive damages
• Loss of profits, data, use, goodwill or other intangible losses
• Arising from your use or inability to use the Application

Our total liability to you for all claims shall not exceed the amount you paid for the Application in the past 12 months, or €50 if you have made no payment.

8.3. Exclusions

Some jurisdictions do not allow the exclusion of implied warranties or the limitation of liability for incidental or consequential damages. In such cases, our limitations may not apply to you.

9. Indemnification

You agree to indemnify, defend and hold Dimosapps harmless from any claim, loss, liability, damage, cost or expense (including legal fees) arising from:

• Your use of the Application
• Your breach of these Terms
• Your violation of any third-party right
• Your user content

10. Termination

10.1. Termination by You

You may terminate your account at any time by deleting your account in the Application settings or by contacting us.

10.2. Termination by Us

We reserve the right to suspend or terminate your access to the Application, with or without notice, for any reason, including if:

• You breach these Terms
• You use the Application fraudulently or illegally
• You fail to pay any fees due
• We decide to cease providing the Application

10.3. Effect of Termination

Upon termination:

• Your right to use the Application will end immediately
• We may delete or disable your account and any associated content
• Provisions of these Terms that by their nature survive termination will continue to apply

11. Personal Data Protection

Your use of the Application is also governed by our Privacy Policy, which explains how we collect, use and protect your personal data. By using the Application, you also accept the practices described in our Privacy Policy.

12. General Provisions

12.1. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dimosapps regarding the use of the Application.

12.2. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.

12.3. No Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.

12.4. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms at any time without notice.

12.5. Force Majeure

We shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, war, pandemics, strikes, network failures or server failures.

13. Changes to the Terms

We reserve the right to modify these Terms at any time. If we make substantial changes, we will inform you by:

• A notification in the Application
• Email to the address associated with your account
• Updating the « Last updated » date at the top of this page

Your continued use of the Application after the changes are posted constitutes your acceptance of the modified Terms. If you do not accept the changes, you must stop using the Application and delete your account.

14. Governing Law and Jurisdiction

14.1. Governing Law

These Terms are governed by and construed in accordance with the laws of France, without regard to conflict of law principles.

14.2. Jurisdiction

Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Paris, France.

14.3. Dispute Resolution

If you reside in the European Union, you also have the right to lodge a complaint with the consumer protection authority in your country of residence.
